Uncontested Divorce

Cooperative / Uncontested Divorce

When you are able to work out how best to handle issues of parenting, support, division of assets and debts, you may still need professional assistance preparing and filing all the required documents.

I can help with this process, by providing guidance on the law and the process, by drafting written settlement agreements and all other required documents, and after everything is signed, filing your case and handling an uncontested final hearing.

By hiring me you will determine what works best for your family and control your family’s future — without worrying about what papers need to be filed or how to navigate court processes.

The Steps:

  1. You and your spouse agree on all settlement terms
  2. You and I review the terms together so nothing is missed
  3. I draft all necessary documents that need to be signed
  4. Your spouse reviews the agreements with their own attorney prior to signing
  5. I file everything in the appropriate court and schedule a brief final hearing (usually by Zoom)
  6. I attend the final hearing with you and send the final judgment to the Court to sign — your official divorce order

Contested Divorce

A contested divorce is a lawsuit involving a formal and adversarial judicial process. It starts with filing a Petition asking for decisions about time sharing, child support, property division, and alimony.

Once a Petition is filed, it must be formally served on the other party. The other party gets at least 20 days to respond, then considerable time and money is spent on the “discovery process” and legal research. Mediation is required before trial.

I have been litigating contested family law matters for 18 years — always approaching even the most contested cases with an eye toward settlement.

What To Expect

  • Formal judicial process from start to finish
  • Petition filed and served on opposing party
  • Discovery process for financial information
  • Mandatory mediation before trial
  • Jill always pushes toward settlement

Additional Areas Of Expertise

Divorce Planning

If you’re thinking about getting a divorce and want to understand the process, I provide legal advice and coaching services so you can better control your own divorce, parenting plans, child support, and alimony case — on an hourly, as-needed basis.

Prenuptial Agreements

Prenuptial agreements are contracts created before marriage to establish the results in case of divorce — generally covering property division, alimony, and premarital assets. Florida has strict requirements for valid prenuptial agreements. I provide guidance throughout this process.

Paternity

A child does not have a legal father in Florida if the mother is not married to the father when the child is born. Establishing paternity gives rights and benefits to the mother, the father and the child. A paternity case can be resolved cooperatively through mediation.

Stepparent / Family Member Adoptions

In an adoption proceeding, a married stepparent can establish a legal relationship with their spouse’s child. The stepparent adoption process is more streamlined than other adoption proceedings. A biological parent can consent to the adoption rather than requiring a court order.

Parenting Plans & Timesharing

Florida requires a parenting plan in all cases involving minor children. Jill works to ensure your parenting plan serves the best interests of your children and reflects your family’s unique needs — whether through negotiation, mediation, or litigation.

Alimony & Child Support

Florida courts consider multiple factors when awarding alimony and calculating child support. Jill provides experienced guidance on initial establishment and subsequent modifications when circumstances change.

Modification & Enforcement Of Judgments

When significant life changes occur — change in income, relocation, or the needs of your children — an existing court order may no longer be appropriate. Jill helps you petition for a modification or enforce an order the other party is not following.

Relocation

Florida law has specific requirements when a parent with a minor child wishes to relocate more than 50 miles from their current residence. Jill provides knowledgeable guidance protecting your relationship with your children throughout any relocation dispute.
